TERMS AND CONDITIONS

ELIGIBILITY
The Kobo 2012 Book Club (the “Program”) is open to residents of Canada who activate a Kobo Touch, and residents of the United States who activate a Kobo Touch or Kobo Touch with Offers.
HOW TO PARTICIPATE:
To participate, you must activate your eligible eReader during the promotional window of November 24, 2011 through March 31, 2012.
To activate your eReader, follow the simple steps outlined in the Quick Start Guide included with your eReader, including signing in to your Kobo account from your Kobo eReader.
Ensure that you have selected to get email updates on the latest Kobo eBooks, offers, and app updates. You can do this when signing up for your free Kobo account or by signing into your existing Kobo account at Kobo.com and ensuring that the Email Update account setting is enabled.
Customers meeting eligibility criteria defined above who complete the “How To Participate” steps above (the “Participants”), will automatically become members of the Program.
PROGRAM DESCRIPTION:
As a member of the Program, you will be offered one free book for each calendar month in 2012 for a total of 12 free book offers.
Your Program selections(s) for the Month will be sent to you by email each month and you will have 7 days to redeem your free book.
- If you completed the “How To Participate” steps before December 31, 2011, you will receive your first Program offer in January 2012 and a new Program offer for each calendar month of 2012 that follows.
- If you completed the “How To Participate” steps in the month of January 2012, you will receive your first and second Program offers in Feburary 2012 and a new Program offer for each calendar month of 2012 that follows.
- If you completed the “How To Participate” steps in the month of February 2012, you will receive your first, second and third Program offers in March 2012 and a new Program offer for each calendar month of 2012 that follows.
- If you completed the “How To Participate” steps in the month of March 2012, you will receive your first, second, third and fourth Program offers in April 2012 and a new Program offer for each calendar month of 2012 that follows.
To redeem your free book, simply search the Kobo store for one of the Program monthly selection(s) and enter the provided promo code at check-out.
The Program monthly selection(s) must be accepted “as is.” No title substitutions will be made; nor are they convertible to cash.
GENERAL CONDITIONS:
The Sponsor reserves the right to cancel, suspend and/or modify the Program, or any part of it, including these Terms and Conditions if any fraud, technical failures or any other factor beyond the Sponsor’s reasonable control impairs the integrity or proper functioning of the Program, as determined by the Sponsor in its sole discretion. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the process or operation of the Program or to be acting in violation of these Terms and Conditions or in an disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Program may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor’s failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.
LIMITATIONS OF LIABILITY
The Sponsor is not responsible for: (1) any incorrect or inaccurate information, whether caused by a Participant or by any of the equipment or programming associated with or utilized in the Program; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the activation process or the Program; (4) technical or human error which may occur in the administration of the Program or the processing of activations. If for any reason any Participant’s activation is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Participant’s sole remedy is to be added to another program, if possible.
APPLICABLE LAW
The Program is governed by the laws of Ontario and the laws of Canada as applicable therein, and is subject to all applicable federal, provincial, state and municipal laws and regulations and is void where prohibited by law. Activation and agreeing to Email Updates constitutes Participant’s full and unconditional agreement to these Terms and Conditions and the Sponsor’s decisions, which are final and binding in all matters related to the Program. By participating in the Program, the courts of the Province of Ontario, Canada shall have jurisdiction to entertain any action or other legal proceedings based on any provision of these Official Rules or the running of this Program.
